Boat Storage – Terms and Conditions

By paying for and agreeing to store your vessel with Windermere Storage Solutions Limited (WSS), you confirm that you have read, understood and agreed to the following terms and conditions.

1. Minimum Storage Term

The minimum storage term is three (3) months.

No refunds will be issued for early removal of the vessel within the initial three-month period.

2. Mandatory Winterisation

All boats must be fully winterised before entering storage.

Winterisation includes, but is not limited to, engine draining, fuel stabilisation, battery disconnection, bilge draining and system checks in accordance with manufacturer guidelines.

WSS may refuse to accept any vessel that has not been properly winterised.

WSS is not responsible for any damage resulting from improper or incomplete winterisation, even if the boat is accepted into storage.

3. Liability Disclaimer

WSS is not liable for mechanical or system-related damage to the boat, engine or equipment that may occur during the storage period, including but not limited to issues arising from cold weather, battery failure, fuel system issues or corrosion, except to the extent that such liability cannot lawfully be excluded.

It is the owner’s responsibility to ensure the vessel is properly prepared prior to storage.

4. Insurance Requirements

A copy of the vessel’s current and valid insurance documentation must be provided to WSS before storage begins.

The owner must also provide a copy of the relevant winter storage insurance invoice or other suitable documentation confirming that the vessel is insured for storage at the applicable WSS storage location, whether indoors or outdoors, as appropriate.

It is the owner’s responsibility to ensure that their insurance policy covers the vessel for the full duration of storage and is valid for the specific type and location of storage being provided.

WSS reserves the right to refuse or suspend storage of any vessel until the required insurance documentation has been received and any necessary confirmation of cover has been provided.

The provision of insurance documentation does not constitute acceptance by WSS of any liability for the vessel.

5. Non-Payment Policy

All storage fees must be paid according to the agreed schedule.

WSS reserves the right to retain possession of the vessel, subject to applicable legal requirements, until all outstanding balances are paid in full.

After 90 days of non-payment, WSS reserves the right to pursue appropriate legal proceedings to recover unpaid fees, including seeking the sale or disposal of the vessel where legally permitted.

6. Access & Retrieval

Access to the storage area is by appointment only.

Boat retrieval requires at least seven (7) days’ notice.

No access is permitted without WSS staff supervision.

7. Storage Conditions

Boats are stored in designated indoor or outdoor storage areas, depending on the service selected.

While all reasonable care is taken, WSS is not responsible for damage caused by weather, pests, theft or vandalism, except to the extent that such damage results from WSS’s negligence or other liability that cannot lawfully be excluded.

8. Owner Responsibilities

The owner is responsible for:

* Ensuring the vessel is properly winterised before storage.
* Providing current and valid insurance documentation before storage begins.
* Providing a copy of the relevant winter storage insurance invoice or other suitable documentation confirming cover for storage at the applicable WSS location, whether indoors or outdoors.
* Ensuring insurance remains valid for the entire storage period and covers the agreed storage arrangements.
* Removing all valuables prior to storage.
* Clearly labelling all loose items or accessories intended to remain with the boat.
* Settling all invoices on time.

9. Termination of Storage

WSS reserves the right to terminate storage with 14 days’ notice, subject to applicable legal requirements and any refunds due being calculated proportionally.

The customer may terminate storage with 14 days’ notice after the three-month minimum term has elapsed.
